NerdWallet Wealth Partners California Privacy Policy

Introduction


This California Privacy Policy contains disclosures required by the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CPRA”) (Civil Code Section 1798.100, et seq.)(collectively, the “CCPA”) and applies solely to eligible residents of the State of California (“California residents,” “consumers,” or “you”). Most of our data collection, use, and sharing practices are governed by our Gramm-Leach-Bliley Privacy Notice, however, if you are an eligible California resident, the CCPA may apply to the NerdWallet Wealth Partners Services, as defined in the NerdWallet Wealth Partners Privacy Policy. This California Privacy Policy should be read in conjunction with the NerdWallet Wealth Partners Privacy Policy and NerdWallet Terms of Use which are incorporated herein by reference.
In this California Privacy Policy, when we talk about “personal information,” we mean information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.

A. Personal Information We Collect, Use, and Disclose for a Business Purpose


In the last twelve (12) months, depending on how you have interacted with us, we may have collected the categories of personal information from or about you identified in the chart below and used and disclosed this information to third parties for business or commercial purposes.

Please note that some of the categories of personal information described in the CCPA overlap with each other; for instance, your name is both an identifier and a type of data described in Cal. Civil Code 1798.80(e).

B. Personal Information We Sell or Share with Third Parties


In addition, as is common practice among companies that operate online, we allow certain third parties, including non-affiliated business partners, advertising networks, analytics providers, and other advertising providers, to directly collect information about your online activities on the site and across your browsers and devices using cookies, web beacons, mobile advertising identifiers and other technologies. These third parties may use this information to display online advertisements tailored to your interests and preferences across your browsers and devices, to conduct ad campaign measurement and site analytics, to detect, prevent and report fraud, or to carry out their own business and commercial purposes. In the preceding twelve (12) months, we have not sold your personal information for direct, monetary profit. However, the collection of information by some of these third parties may constitute a “sale” or “sharing” of personal information, as defined under the CCPA. Your interactions with these third parties are governed by the third parties’ privacy policies. In the preceding twelve (12) months, we have not sold or shared any categories of personal information with third parties.

C. Categories of Sources from Which We Collect Personal Information


We may collect this personal information directly from you.
We may also, at your direction, obtain information about you from third parties when you use NerdWallet Wealth Partners Services. In addition, you may direct and enable us to collect personal information you maintain in financial accounts with other third-party financial institutions and similar companies.
We may also collect personal information about you (for example, information regarding how you interact with the NerdWallet Wealth Partners Services) using automated tools as described elsewhere in this policy.

D. Why We Collect, Use, and Share Personal Information


We use and disclose the personal information we collect for our commercial and business purposes, as further described in this Privacy Policy and the NerdWallet Wealth Partners Privacy Policy.
Commercial purposes include, without limitation: marketing and advertising our Services to you, authentication, identity resolution, fraud prevention, and the fulfillment of services you request.
Business purposes, as identified in the CCPA, include: audits and related activities; legal compliance; detecting and protecting against security incidents, fraud, and illegal activity; debugging services and systems; administrative and support services such as processing orders and payments and analytics; internal research and operations; activities to maintain and improve the NerdWallet Wealth Partners Services; and other one-time uses.

E. Disclosing Your Personal Information


We disclose the categories of personal information designated above to the following categories of third parties: our service providers, financial institutions, internet service providers, data analytics providers, operating system providers and professional services organizations.
We also allow third parties to collect information about your use of our site through third party cookies and the data collected by these third party cookies may be used to display cross-context behavioral online advertisements tailored to your interests and preferences across your browsers and devices or to conduct ad campaign measurement.
We have not and will not make your personal information available to third parties for monetary consideration.

F. Your Rights Regarding Personal Information


Eligible California residents have certain rights with respect to the personal information collected by businesses. If you are an eligible California resident, you may exercise the following rights regarding your personal information, subject to certain exceptions and limitations:
  • The right to know/access the categories and specific pieces of personal information we collect, use, disclose and, if applicable, sell about you. Upon the submission of a verifiable consumer request (see “How to Exercise Your California Consumer Privacy Rights” below), we will disclose to you:
    • the categories of personal information we collected about you;
    • the categories of sources from which we collected your personal information;
    • the business or commercial purposes for collecting or, if applicable, selling your personal information;
    • the categories of your personal information that we have disclosed for a business purpose or, if applicable, sold; and
    • the categories of third parties to whom we have disclosed for a business purpose or, if applicable, sold personal information.

    We will also provide the specific pieces of personal information we collected about you, subject to certain exceptions under applicable law, if you request access to such information.
  • The right to request that we delete the personal information we have collected from you and retained, subject to certain exceptions.
  • The right to request that we correct inaccurate personal information that we maintain about you, subject to certain exceptions.
  • The right to opt out of our sale(s) or sharing of your personal information. We do not sell your personal information for direct, monetary profit. However, as described above, we may engage in certain information disclosure activities that may be considered “sales” or “sharing” under the CCPA (see Section B above). If NerdWallet Wealth Partners sells your personal information to or shares such information with third parties, you may have the right to opt out of the sale or sharing of such information.

    To exercise the right to opt out, you (or your authorized agent) may submit a request to us by visiting NerdWallet Wealth Partners’ Privacy Preferences page.
  • The right not to receive discriminatory treatment for the exercise of the privacy rights conferred by the CCPA. Unless permitted by applicable law, we will not:
    • Deny you goods or services.
    • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
    • Provide you a different level or quality of goods or services.
    • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
  • The right to appeal any decision or indecision related to the exercise of the privacy rights conferred by the CCPA.

Do Not Sell or Share My Personal Information

If you have an opt out preference signal enabled (e.g., the Global Privacy Control), you will automatically be opted out of the sale or sharing of your information, but we may ask you to confirm your preference if you have previously consented to the sale or sharing of your personal information. Please also note that if you have an account with us, but are not logged into your account, we may not be able to associate the browser or device information connected to your opt out preference signal with you. If you would like for us to make this connection, you may submit additional information to us by emailing privacy@nerdwallet.com.

Please note that opting out of the sale or sharing of your personal information may impair some features and functionality of the NerdWallet Wealth Partners Services.

G. How to Exercise Your California Consumer Privacy Rights


To exercise your California consumer rights described above, please visit our Privacy Preferences page. You may also submit your CCPA request by sending us an email at privacy@nerdwallet.com with the subject line “CCPA Request” and the relevant right identified in the body of the email, or visiting https://support.nerdwallet.com, and submitting your request via the chatbot in the bottom right hand corner.
On certain of our websites, users can make choices regarding the use of cookies and related technologies through a cookie banner management tool. On all our other websites and digital properties, users can:
  • Visit privacyrights.info to opt out from sales of this type of personal information by third-party businesses that participate in the DAA’s CCPA Opt-Out Tool, and
  • Visit myaccount.google.com/data-and-personalization, scroll down to the “Ad personalization” section, click “Go to ad settings” and toggle “Ad personalization” to OFF, and
  • Follow the instructions in the “Third-party web beacons and third-party buttons” section in the NerdWallet Wealth Partners Privacy Policy to opt out of interest-based advertising and other cookie-related information collection and processing.

Verification Process and Required Information

Note that we may need to request additional information from you to verify your identity or understand the scope of your request, although you will not be required to create an account with us to submit a request or have it fulfilled. We will require you to provide information that we have on record for identity verification purposes. In certain circumstances, we may decline a request to exercise the right to know, access, correct, and/or delete your personal information, particularly where we are unable to verify your identity.

Authorized Agent

Only you, your parent, guardian (if you are under 13 years or age), conservator, a person to whom you have given power of attorney pursuant to California Probate Code sections 4000 to 4465, or an authorized agent may make a verifiable consumer request related to your personal information. You may, however, make a verifiable consumer request on behalf of your minor child if necessary. You may designate an authorized agent to make a CCPA request on your behalf by writing to us at the contact information provided above. To the extent we are unable to verify your identity when you make the designation request, we may request additional information from you. Note, if designating an entity to act on your behalf, the CCPA requires that such entity must be registered with the California Secretary of State.

H. Shine the Light


In addition to your rights under the CCPA, California Civil Code Section 1798.83 gives eligible California residents the right to request certain details about how your information is shared with third parties for direct marketing purposes. I. Minors' Right to Opt In


We do not sell the personal information of consumers we know to be under 16 years of age.

How Long We Retain Your Personal Information


NerdWallet Wealth Partners may retain your personal information for as long as is necessary to carry out the purposes set out in this Privacy Policy or as otherwise required or permitted by applicable law, and will delete or de-identify the information thereafter.
When determining the retention period, we take into account various criteria, such as the nature of the use of our Services, your general relationship with us, the impact on our ability to provide you our Services if we delete your personal information, mandatory retention periods provided by law and the statute of limitations, and our use of your personal information for aggregated market research.
If you no longer want NerdWallet Wealth Partners to use your information to provide the NerdWallet Wealth Partners Services to you, you may close your account. There may be occasions where we are unable to fully delete, anonymize, or de-identify your information due to technical, legal, regulatory compliance or other operational reasons. Where this is the case, we will take reasonable measures to securely isolate your personal information from any further processing until such time as we are able to delete, anonymize, or de-identify it.
